Pink Martini invites our North American fans to create a clever, inspired music video for the band for one of six songs from the new CD Splendor in the Grass:

“Ninna nanna,” “Ohayoo Ohio,” “Splendor in the Grass,” Où est ma tête?,” “And Then You’re Gone,” or “Over the Valley.”

The video should include the complete song for whichever song you choose. Lyrics for the songs are available HERE. All songs can be streamed HERE. Please do not include violent images in the films. You must be a resident of the United States, Canada or Mexico to enter this contest.

By entering this contest, you authorize Pink Martini and Heinz Records to use your video, regardless of whether or not it is chosen as a winner, in whatever way we choose, for the purpose of promotion only.

Videos will be judged on ingenuity, concept, and production quality (not view count) by the Pink Martini band and staff. No family member or employee of Pink Martini or its partner labels or businesses permitted to enter. All decisions by the judges are final.

FIRST PRIZE
Two round trip plane tickets to Nice (from a major North American airport), three nights for two at a hotel, and two tickets to see Pink Martini perform at the Nice Jazz Festival on July 24, 2010. In addition, the winner will receive €500 cash, and a package of special Pink Martini paraphernalia. Instead of above first prize, winner may, alternately, choose a $2500 cash prize.

SECOND PRIZE
Two tickets to any Pink Martini show in the US or Canada in 2010, $250 cash, and a package of Pink Martini paraphernalia.

THIRD PRIZE
Two tickets to any Pink Martini show in the US or Canada in 2010, and a package of Pink Martini paraphernalia.

By entering this contest, whether or not your entry is chosen as a winner, you agree to the following terms and conditions:
All artistic, literary, dramatic and other material submitted by you and all results and proceeds of your activities in connection with the Contest, shall be hereinafter referred to as the “Work”. “Your activities” shall include the activities of all third parties whom you may involve in the Contest. You hereby agree that the Work shall be considered a “work made for hire” for Pink Martini and shall be entirely Pink Martini’s property in perpetuity throughout the universe, free of any claim whatsoever by you or by any persons deriving any rights or interests from you. If for any reason, it is determined that the Work does not so constitute a “work made for hire, you hereby assign to Pink Martini all copyrights in the Work for the life of such copyrights. Pink Martini shall have the sole and exclusive right in perpetuity throughout the universe, for no additional consideration to you, to manufacture, advertise, sell, license or otherwise exploit the Work, and any portion thereof, in any and all manner and media now known or hereafter devised. You acknowledge and agree that you shall have no right of consultation or approval with respect to Pink Martini’s exploitation, revision and/or use of the Work. You further grant to Pink Martini the right to use your name, likeness, and biographical data in connection with the distribution, exhibition, advertising and exploitation of the Work.

You further warrant and represent that the Work shall be free of any claims by any person or entity (excluding the musical composition and master recording supplied by Pink Martini) and will not violate or infringe upon the rights of any person or entity. You warrant and represent that you are over the age of eighteen and have the right to enter the Contest on the terms and conditions set forth herein, including the right to grant the rights granted by you to Pink Martini and to fulfill and perform all of the obligations required of you hereunder. You shall indemnify and hold Pink Martini harmless from and against any losses, costs, liabilities, claims, damages or expenses arising out of any claim by a third party which is inconsistent with any warranty or representation or covenant made by you hereunder in connection with the Contest.
